LEGAL TERMS AND CONDITIONS FOR THE DRAWING

Pikolinos Intercontinental S.A., with Tax ID (CIF) A53238713 and with registered office at Calle Galileo Galilei, 2, 03203-Elche (Spain),phone number +34 965681234, email address: info@pikolinos.com, is implementing a sales promotion to promote the activities of the company which will be carried out in accordance with the following conditions.

Pikolinos Intercontinental S.A. reserves the right to postpone, nullify, repeat, or terminate the contest or modify its rules at any time if exceptional circumstances arise, communicating said circumstances in a way that prevents any damage to the participants in the contest.

1. SCOPE AND DURATION

The Contest will have an international scope (USA, Germany, France, and Spain) and will be held on:

Contest participation will be open from 11:00 a.m. on January 24, 2022, until 11:00 p.m. on February 11, 2022, Central European Time. This period will be extended or shortened by Pikolinos if it sees fit, communicating that decision through the corresponding website and terms and conditions.

These Terms and Conditions establish the requirements and rules for participation that must be accepted by all people who want to participate in the Contest (henceforth known as Participants or, individually, The Participant). The effective participation of the Participants in the Contest through means that are established herein signifies the acceptance of requirements and rules stipulated here in their entirety, unequivocally and without exception.

2. PARTICIPANTS

Any person who is of legal age and who fulfills all requirements established in these terms and conditions may participate in the contest at no cost.

Employees and collaborators of the company holding the contest,and of any of the other companies in the corporate group that it pertains to, may not be named winners of this promotion, nor, in general, may any of their respective family members, relatives in the ascending and descending line, spouses and/or common-law partners.

3. COMMUNICATION AND PUBLICATION OF THE PROMOTION

This contest will be communicated to Pikolinos customers through email.

4. MECHANICS OF THE CONTEST AND OF PARTICIPATION

–        To participate, the Participant must:

a.    Fill out the customer satisfaction survey.

b.    Indicate his/her email address in the corresponding box.

–        Please consult Item 10 in these Terms and Conditions for information regarding the Data Protection Policy.

In the event that Pikolinos detects misuse or acts that are fraudulent or damaging for the remaining participants by one or more participants, Pikolinos may terminate the participation of said offending persons in the contest. In the event that Pikolinos, aswell as any other entity associated with it, detects any anomaly or suspects that a participant is impeding the normal development of the Contest, altering their records through any technical or cyber method, or carrying out any fraudulent acts that contravene the transparency of this promotion, the participation of said participant will be terminated, and the appropriate legal action will be undertaken.

5. WINNER SELECTION

Four (4) winners will be chosen from all correct and complete entries received before the end date in a random drawing on the platform Sortea2.com. The winner will receive an iPhone 13 mini as his/her prize.

6. MECHANICS OF THE CONTEST AND PRIZE NOTIFICATION

The Promotor will communicate with the winner by email within the week following the end date of the Promotion. The Promotor will send an email to the winner from the email address: info@pikolinos.com.

The winner must confirm that the email has been received within 72 hours of the email being sent. PIKOLINOS INTERCONTINENTAL S.A. reserves the right to substitute the winner with another contestant, in the event that the winner does not accept the prize or it is impossible to contact the winner. In this case, the lucky winner will forfeit their claim to the prize, and the prize will be awarded to the second winner. If this second winner also cannot be contacted in the span of thirty (30) calendar days from the selection of the winner or in the event of any of the circumstances previously mentioned, the prize will be declared abandoned. If the winner renounces the prize, the renouncer will not be awarded the right to payment nor any other compensation, nor may the prize be exchanged for cash, except in those cases in which PIKOLINOS decides to do so. If, for reasons beyond the control of PIKOLINOS, it is impossible to deliver the stated prize (whether in part or in total),PIKOLINOS reserves the right to substitute it for a comparable prize. The designation of the winners will not be actionable. Complaints will not be accepted nor will any type of communication or correspondence in respect to it be initiated with PIKOLINOS.

7. PRIZE

The winner of the drawing will be awarded the following prize:

–        The prize consists of one iPhone 13 mini.

If, for any reason beyond the control of Pikolinos, the intended prize is not available, Pikolinos reserves the right to substitute it for another of equal value.

–        Pikolinos is exempt from all responsibility with respect to any incidences out of its control that may occur during the period that the prize is delivered.

–        The winner of this contest will not be permitted to exchange the prize for a different one nor for its cash value.

Pikolinos will notbe held responsible for the following situations:

–        For the services related to the prize of this promotion that third-party businesses must provide.

–        For damages of any nature that may be due to the temporary unavailability or operational discontinuity of telecommunications networks.

The prize may not be exchanged for cash or any other object in kind.

8. PUBLICITY OF THE PRIZE

The express acceptance of the prize by each winner signifies:

a)    That he/she authorizes Pikolinos Intercontinental S.A. (or any other third-party authorized by it) to use the name of, image of, and/or comments made by the Participants, in the case of winning the prize, for the purpose of marketing, promotions, and publicity of the Contest in any medium and in any part of the world, without any type of remuneration.

b)    That the name of the Participant appears published in Pikolinos’ official channels of communication.

9. DATA PROTECTION

In accordance with the current regulations regarding data protection, the Purpose of data processing is:

a)    The participation in the contests, promotions, and drawings organized by PIKOLINOS. The legal grounds for the data processing are the consent of the interested party and/or his/her legal representation, and the data will be saved until the end of the contest, as well as for the time necessary to fulfill the legal obligations that may apply.

Data recipients: Data will not be disclosed, except in the case that authorization has been granted to disclose the image, to social media, other media, and the public, and only for the purpose of promoting and publicizing the contest carried out by PIKOLINOS.

International Data Transfers: Data will not be transferred internationally.

Rights of the interested party:

– Access: the right to obtain confirmation of whether we are processing his/her personal data, specifically, which ones, what they are used for, how much time they will be saved, their origin, and if they have been or will be communicated to a third party.

– Rectification: the right to request the rectification of inexact data and the completion of incomplete personal data.

– Erasure: the right to request the erasure of personal data when they are inappropriate, excessive, or they are no longer necessary for the purposes for which they were collected, included in the right to be forgotten.

– Objection: the right to object, in specific circumstances, to his/her personal data being processed or to request that processing be ceased.

– Restriction of Processing: the right to request, in the legally established circumstances, that his/her data are not processed beyond their mere retention.

– Portability: the right to receive personal data in a format that is structured, of common use, and is machine readable, and to be able to transmit them to another controller, as long as this is technologically possible.

Exercising your rights: Your rights must be exercised in writing and sent with a photocopy of your ID to the previously stated address or through an email to the abovementioned email address, attaching a copy of your ID.

The right to lodge a complaint before the Supervisory Authority: In the event that your rights have not been respected, you may lodge a complaint by writing to the Spanish Data Protection Agency located at Calle Jorge Juan, 6-28001-Madrid or through the virtual office: https://sedeagpd.gob.es. In both cases, the pertinent documentation must accompany it.

10. EXCLUSIONS

Any person who does not completely and correctly fulfill the requirements for participation laid out in these Terms and Conditions will not be a winner.

Employees and collaborators of the Pikolinos Group are excluded from the prize.

11. ACCEPTANCE OF THESE TERMS AND CONDITIONS

The participation in this contest, in and of itself, signifies the acceptance of these terms and conditions, as well as the decisions the company makes through the interpretation of them.

Furthermore, the participation in this contest signifies the acceptance of the guidelines of Instagram, and the exemption of the social media platform from all responsibility. This contest is not sponsored, sanctioned, or operated by the abovementioned social media platform.

12. APPLICABLE LAW AND JURISDICTION

These legal bases will be interpreted and applied in compliance with Spanish legislation.

Any litigious matter derived from the existence, access, utilization, or content of these Legal Terms and Conditions, of either the customer or Pikolinos, will be subject to:

·         The courts of the city of Elche, or if there are no business courts in that city, the courts of Alicante will have jurisdiction, when the user is a business owner.

·         The courts of the city of residence of the user, when the user is a consumer, in accordance with current legislation.

Pikolinos Intercontinental S.A se reserva el derecho de aplazar, anular, modificar las normas, repetir o dar por terminado el concurso en cualquier momento si concurrieran circunstancias excepcionales, comunicando dichas circunstancias de manera que se evite cualquier perjuicio para los participantes en el concurso.

El período durante el cual estará abierta la participación en el Concurso será desde las 11:00 am del 24 de enero de 2022 hasta las 23.00 pm del día 11 de febrero de 2022 hora España peninsular. Este período podrá ser ampliado o reducido por Pikolinos si así lo estimase oportuno, comunicando tal decisión en la página y bases correspondientes.

Las presentes Bases establecen los requisitos y la normativa de participación que deben ser aceptadas por todas aquellas personas que quieran participar en el Concurso (en adelante, los Participantes o, individualmente, El Participante).
La participación efectiva de los Participantes en el Concurso por los medios que aquí se establecen, supondrá de forma inequívoca y sin excepción alguna que ha habido una aceptación de la totalidad de los requisitos y la normativa que aquí se estipulan. 

2º.- PARTICIPANTES

Podrán participar gratuitamente en el concurso todas aquellas personas mayores de edad que cumplan todos los requisitos establecidos en las presentes bases.

No podrán resultar ganadores de esta promoción los trabajadores y colaboradores de la empresa convocante,ni de cualesquiera de las empresas del grupo empresarial al que pertenece ni, en general, sus respectivos familiares, ascendientes, descendientes, cónyuges y/o parejas de hecho.

3º.-COMUNICACIÓN Y PUBLICACIÓN DE LA PROMOCIÓN

El presente concurso se comunicará a través del canal email a los clientes de Pikolinos.

4º.- MECÁNICA DEL CONCURSO Y DE LA PARTICIPACIÓN

–        Para participar se deberá:

a.    Rellenar la encuesta de satisfacción

b.    Indicar el correo electrónico en la casilla correspondiente.

–        En relación con la Política de Protección de Datos, les rogamos consulten el Punto 10 de las presentes bases.

En el caso de que Pikolinos detecte un mal uso, actos fraudulentos o perjudiciales para los restantes participantes por parte de uno o varios participantes, podrá dar de baja la participación de dichas personas infractoras. En el caso de que Pikolinos, asícomo cualquier otra entidad ligada a ella, detecte cualquier anomalía o sospeche que un participante está impidiendo el normal desarrollo del Concurso alterando sus registros mediante cualquier procedimiento técnico o informático o llevando a cabo cualesquiera actos fraudulentos que contravengan la transparencia de la promoción se procederá a dar de baja a dicho participante, así como a emprender las acciones legales oportunas.

5º.- ELECCIÓN DEL GANADOR

Se designarán 4 ganadores entre todas las participaciones recibidas, completas, y correctas antes de la fecha de finalización a través de un sorteo aleatorio en la plataforma Sortea2.com. El ganador recibirá como premio un Iphone 13 mini.

6º.- MECÁNICA DEL CONCURSO Y NOTIFICACIÓN DEL PREMIO

El Promotor se comunicará con el ganador por correo electrónico dentro de la semana siguiente a la fecha de finalización de la Promoción. El Promotor enviará un e-mail al ganador desde la dirección de correo: info@pikolinos.com.

El ganador deberá confirmar la recepción del email dentro de las 72h siguientes a su envío. PIKOLINOS INTERCONTINENTAL S.A. se reserva la capacidad para sustituir al ganador por otro concursante, en caso de sustitución, no aceptación o la imposibilidad de ponerse en contacto con el ganador. En ese caso, el agraciado/a perderá los derechos sobre el premio, siendo otorgado el premio al segundo ganador y si éste segundo ganador tampoco pudiera ser contactado en el plazo de treinta (30) días naturales desde la elección del ganador o se dieran las circunstancias anteriormente enumeradas, el premio será declarado desierto.

La renuncia al premio no otorgará al renunciante derecho a indemnización o compensación alguna, ni canjes por dinero, excepto en aquellos casos en los que así se decida por PIKOLINOS. Si por causas ajenas a PIKOLINOS fuese imposible la entrega del premio establecido (ya sea en su totalidad o en parte),PIKOLINOS se reserva el derecho a la sustitución por un premio equivalente. La designación de los ganadores no será recurrible y no se aceptarán reclamaciones ni se entablará ningún tipo de comunicación o correspondencia al respecto con PIKOLINOS.

7º PREMIO

El ganador del sorteo optará al siguiente premio:

–        El premio consiste en un Iphone 13 mini.

Si por cualquier razón ajena a Pikolinos, no hubiera disponibilidad del premio previsto, ésta se reserva el derecho de sustituirlos por otros, de igual coste.

–        Pikolinos se exime de toda responsabilidad con respecto a las incidencias que ajenas a su voluntad, pudieran ocasionarse en el transcurso del premio.

–        El ganador del presente concurso no podrá canjear el premio ganado por otro distinto ni por la cantidad equivalente al mismo.

Pikolinosno será además responsable de los siguientes extremos:

–        Por los servicios que terceras empresas deban prestar con motivo del premio de la presente promoción.

–        Por daños y perjuicios de toda naturaleza que puedan deberse a la falta temporal de disponibilidad o de continuidad del funcionamiento de las redes de telecomunicaciones.

El premio no es canjeable por dinero ni por cualquier otro objeto en especie.

8º.- PUBLICIDAD DEL PREMIO

La aceptación expresa del premio por parte de cada ganador/a implica:

a)    Que usted autoriza a Pikolinos Intercontinental S.A (o cualquier tercero autorizado por ésta) a utilizar su nombre, la imagen y/o comentarios hechos por los Participantes, en el supuesto de ganar el premio, con fines de marketing, promoción y publicidad del Concurso en cualquier medio y en cualquier parte del mundo, sin ningún tipo de remuneración por ello.

b)    Que su nombre aparezca publicado en los canales de comunicación oficiales de Pikolinos.

9º.- PROTECCIÓN DE DATOS

De acuerdo con la normativa vigente en materia de protección de datos la Finalidad del tratamiento es:

a)    La participación en los concursos, promociones y sorteos organizados por PIKOLINOS. La base legal para el tratamiento de sus datos es el consentimiento del interesado y/o su representante legal y los datos serán guardados hasta la finalización del concurso, así como durante el tiempo necesario para cumplir con las obligaciones legales que puedan ser de aplicación.

Destinatarios de datos: No se realizarán cesiones de datos salvo, en el caso de que nos haya dado su autorización para la cesión de la imagen, a redes sociales, medios de comunicación y al público en general y solamente con la finalidad de promocionar y dar a conocer el concurso realizado por PIKOLINOS.

Transferencias Internacionales de datos: No se realizarán transferencias internacionales de datos.

Derechos del interesado:

– Acceso: derecho a obtener confirmación sobre si estamos tratando datos personales suyos o no, a saber, cuáles son, para que se usan, cuánto tiempo se van a guardar, el origen de los mismos y si se han comunicado o se van a comunicar a un tercero.

– Rectificación: derecho a solicitar la rectificación de los datos inexactos y a que se completen los datos personales incompletos.

10º.- EXCLUSIONES

No podrá resultar ganadora ninguna persona que no cumpla total y adecuadamente los requisitos de participación descritos en las presentes Bases.

Quedan excluidos del premio los trabajadores y colaboradores del Grupo Pikolinos.

11º.- ACEPTACIÓN DE LAS PRESENTES BASES

La participación en este concurso implica, por sí misma, la aceptación de las presentes bases, así como las decisiones interpretativas que la sociedad haga de las mismas.

Asimismo, la participación en el presente concurso supone la aceptación de las normas de Instagram, y la exoneración a la red social de toda responsabilidad. El presente concurso no está patrocinado, avalado ni administrado por la red social mencionada.

12º LEY APLICABLE Y JURISDICCIÓN

Las presentes bases legales se interpretarán y regirán de conformidad con la legislación española.

Para cualquier cuestión litigiosa derivada de la existencia, acceso, utilización o contenido de las Bases Legales, tanto el cliente como Pikolinos, se someterán:

·         A los juzgados y tribunales de la ciudad de Elche, o de no existir juzgados de lo mercantil tal ciudad, serán competentes los de Alicante cuando el usuario sea empresario.

·         A los juzgados y tribunales de la ciudad del domicilio del usuario, cuando se trate de un consumidor de acuerdo a la legislación vigente.

Der Zeitraum für die Teilnahme an der Verlosung ist vom 24. Januar 2022, 11:00 Uhr bis 11. Februar 2022, 23:00 Uhr MEZ. Dieser Zeitraum kann auf Pikolinos Ermessen verlängert oder verkürzt werden, indem diese Entscheidung auf der entsprechenden Seite und den entsprechenden Teilnahmebedingungen bekannt gegeben wird.

Die vorliegenden Teilnahmebedingungen legen die Teilnahmeanforderungen und -bedingungen fest, die von jeder Person, die an der Verlosung teilnehmen möchte (im Folgenden, die Teilnehmer oder einzeln, der Teilnehmer) akzeptiert werden müssen.
Die tatsächliche Teilnahme an der Verlosung durch die hier beschriebenen Medien setzt eindeutig und ausnahmslos voraus, dass alle hierin festgelegten Anforderungen und Teilnahmebedingungen vollständig angenommen wurden.

4.- ABLÄUFE DER VERLOSUNG UND TEILNAHME

–        Zum Teilnehmen müssen Sie:

a.       Die Zufriedenheitsumfrage ausfüllen.

b.       Im entsprechenden Feld die E-Mail-Adresse angeben.

–        Bezüglich der Datenschutzerklärung verweisen wir auf Punkt 10 der vorliegenden Teilnahmebedingungen.

Sollte Pikolinos einen Missbrauch, betrügerische oder für die übrigen Teilnehmer schadende Handlungen eines oder mehreren Teilnehmern feststellen, kann die Teilnahme dieser rechtsverletzenden Personen entziehen. Solle Pikolinos oder jede andere mit ihr verbundene Einrichtung Anomalien feststellen oder den Verdacht haben, dass ein Teilnehmer den normalen Ablauf der Verlosung stört, indem Registrierungen mittels technischer oder computertechnischer Mittel oder durch betrügerische Handlungen, die der Transparenz der Absatzförderung widersprechen, wird dieser Teilnehmer von der Teilnahme ausgeschlossen und entsprechende rechtliche Schritte eingeleitet.

5.- GEWINNERZIEHUNG

Aus allen eingegangenen, vollständig und korrekt ausgefüllten Teilnahmen, werden zum Verlosungsende 4 Gewinner per Zufallsprinzip auf der Plattform Sortea2.com gezogen. Der Gewinner erhält ein Phone 13 Mini als Preis.

6.- VERLOSUNGSABLAUF UND BENACHRICHTIGUNG ÜBER DEN PREIS

Der Veranstalter kontaktiert den Gewinner innerhalb einer Woche nach Ablauf der Absatzförderung per E-Mail. Der Veranstalter schickt dem Gewinner eine E-Mail vom E-Mail-Konto: info@pikolinos.com.

Der Gewinner muss den Erhalt der E-Mail innerhalb von 72 Stunden nach Versand bestätigen. PIKOLINOS INTERCONTINENTAL S.A. behält sich das Recht vor, den Gewinner durch einen anderen Teilnehmer zu ersetzen, im Falle eines Ersatzes, der Nichtannahme oder der Unmöglichkeit, den Gewinner zu kontaktieren. In diesem Fall verliert der Gewinner den Anspruch auf den Preis und dieser wird dem zweiten Gewinner zuerkannt. Wenn der zweite Gewinner nicht innerhalb von dreißig (30) Kalendertagen nach der Gewinnerziehung kontaktiert werden kann oder wenn die oben genannten Umstände eintreten, wird der Preis für ungültig erklärt.
Der Gewinnverzicht berechtigt den Verzichtenden weder zu einer Entschädigung noch zu einem Geldausgleich, es sei denn, dies wird von PIKOLINOS beschlossen. Ist es PIKOLINOS aus Gründen, die außerhalb ihres Einflussbereichs liegen, nicht möglich, den festgelegten Gewinn (ganz oder teilweise) zuzustellen, behält sich PIKOLINOS das Recht vor, diesen durch einen gleichwertigen Gewinn zu ersetzen. Die Ermittlung der Gewinner ist unanfechtbar und es werden weder Ansprüche akzeptiert noch wird mit PIKOLINOS diesbezüglich eine Kommunikation oder Korrespondenz geführt.

7.- PREIS

Der Gewinner der Verlosung hat Anspruch auf folgenden Preis:

–        Der Preis besteht aus einem IPhone 13 Mini.

Sollte der Preis aus einem nicht von Pikolinos zu vertretendem Grunde nicht verfügbar sein, behält sich Pikolinos das Recht vor, den Preis durch einen anderen, gleichwertigen Preis zu ersetzen.

–        Pikolinos lehnt jede Haftung für Zwischenfälle ab, die während der Verlosung auftreten können und die außerhalb ihrer Kontrolle liegen.

–        Der Gewinner dieser Verlosung kann den gewonnenen Preis weder gegen einen anderen Preis noch gegen einen gleichwertigen Betrag eintauschen.

Pikolinos ist zudem nicht verantwortlich für Folgendes:

–        Für die Dienstleistungen, die Drittunternehmen im Zusammenhang mit dem Gewinn dieser Absatzförderung erbringen müssen.

–        Für Schäden jeglicher Art, die auf die vorübergehende Nichtverfügbarkeit oder Kontinuität des Betriebs der Telekommunikationsnetze zurückzuführen sind.

Der Preis kann nicht gegen Geld oder einen anderen Sachgegenstand eingetauscht werden.

8.- BEKANNTMACHUNG DES PREISES

Die ausdrückliche Annahme des Preises durch den jeweiligen Gewinner schließt ein:

a)    Dass Sie Pikolinos Intercontinental S.A. (oder einem von ihm beauftragten Dritten) die Erlaubnis erteilen, Ihren Namen, Ihr Bild und/oder die von den Teilnehmern abgegebenen Kommentare im Falle des Preisgewinns für die Marketing-, Promotion- und Werbezwecke der Verlosung in jedem Medium und überall auf der Welt zu verwenden, ohne dass dafür irgendeine Art von Vergütung anfällt.

b)    Dass ihr Name in den offiziellen Kommunikationskanälen von Pikolinos veröffentlicht wird.

In beiden Fällen müssen dem Antrag die entsprechenden Unterlagen beigefügt werden.

10.- AUSSCHLÜSSE

Wer die in diesen Regeln beschriebenen Teilnahmebedingungen nicht vollständig und ordnungsgemäß erfüllt, kann nicht gewinnen.

Angestellte und Mitarbeiter der Pikolinos-Gruppe sind von der Preisvergabe ausgeschlossen.

11.- ANNAHME DIESER TEILNAHMEBEDINGUNGEN

Mit seiner Teilnahme an den Wettbewerben bestätigt der Teilnehmer,die Annahme der vorliegenden Teilnahmebedingungen sowie der von der Gesellschaft getroffenen Auslegungsentscheidungen.

Die Teilnahme an dieser Verlosung bedeutet auch die Annahme der Instagram-Regeln und die Entlastung des sozialen Netzwerks von jeglicher Haftung. Diese Verlosung wird nicht von dem genannten sozialen Netzwerk gesponsert, unterstützt oder verwaltet.

12. ANWENDBARES RECHT UND GERICHTSBARKEIT

Die vorliegenden Teilnahmebedingungen werden gemäß dem spanischen Recht ausgelegt und geregelt.

La période pendant laquelle la participation au concours sera ouverte ira du 24 janvier 2022 à 11 h au 11 février 2022 à 23 h, heure de l’Espagne continentale. Cette période peut être prolongée ou réduite par Pikolinos si elle le juge opportun, en communiquant cette décision sur la page et le règlement correspondants.

Le présent règlement établit les exigences et les règles de participation qui doivent être acceptées par tous ceux qui souhaitent participer au concours (ci-après, « les participants » ou, individuellement, « le participant »).
La participation effective des participants au concours par les moyens établis dans les présentes, impliquera sans équivoque et sans exception, l’acceptation de toutes les exigences et règles stipulées dans les présentes. 

2º.- PARTICIPANTS

Toutes les personnes majeures qui remplissent toutes les conditions énoncées dans le présent règlement peuvent participer gratuitement au concours.

4º.- MÉCANISMES DU CONCOURS ET PARTICIPATION

–        Pour participer, vous devez :

a.    Remplir l’enquête de satisfaction.

b.    Saisir votre adresse e-mail dans la case appropriée.

–        Concernant la politique de protection des données, veuillez vous référer au point 10 du présent règlement.

Dans le cas où Pikolinos détecte des abus, des actes frauduleux ou des actes préjudiciables aux autres participants de la part d’un ou plusieurs participants, elle peut annuler la participation desdites personnes fautives. Dans le cas où Pikolinos, ainsi que toute autre entité qui lui est liée, détecte une anomalie ou soupçonne qu’un participant entrave le déroulement normal du concours en modifiant ses registres au moyen de tout procédé technique ou informatique ou en réalisant des actes frauduleux qui contreviennent à la transparence de la promotion, elle procédera à la radiation dudit participant, ainsi qu’à l’engagement des poursuites judiciaires appropriées.

5º.- CHOIX DU GAGNANT

4 gagnants seront désignés parmi toutes les participations reçues, complètes et correctes avant la date de clôture par un tirage au sort sur la plateforme Sortea2.com. Le gagnant recevra comme prix un iPhone 13 mini.

6º.- MÉCANISME DU CONCOURS ET NOTIFICATION DU PRIX

Le promoteur contactera le gagnant par e-mail dans un délai d’une semaine à compter de la date de fin de la promotion. Le promoteur enverra un e-mail au gagnant depuis l’adresse e-mail suivante : info@pikolinos.com.

Le gagnant doit confirmer la réception de l’e-mail dans les 72 heures suivant son envoi. PIKOLINOS INTERCONTINENTAL S.A. se réserve le droit de remplacer le gagnant par un autre participant en cas de substitution, de non-acceptation ou d’impossibilité de contacter le gagnant. Dans ce cas, le ou la gagnant(e) perdra ses droits sur le prix, le prix étant attribué au second gagnant et si le second gagnant ne peut être contacté dans les trente (30) jours civils suivant l’élection du gagnant ou si les circonstances énumérées ci-dessus se produisent, le prix sera déclaré nul.
