BASES LEGALES SORTEO “SAN VALENTÍN”

Pikolinos, cuya razón social es Pikostore S.L con CIF B53906590 y con domicilio social en Calle Galileo Galilei, 2, 03203-Elche (España). Teléfono 965681234, correo electrónico: info@pikolinos.com, realiza una promoción comercial denominada “SAN VALENTÍN” (en adelante, el Concurso) para promocionar las actividades de la empresa y que se desarrollará bajo las siguientes condiciones. Pikostore S.L.U. se reserva el derecho de aplazar, anular, modificar las normas, repetir o dar por terminado el concurso en cualquier momento si concurrieran circunstancias excepcionales, comunicando dichas circunstancias de manera que se evite cualquier perjuicio para los participantes en el concurso.

1º.- ÁMBITO Y DURACIÓN

El Concurso se desarrollará a través de las redes sociales de PIKOLINOS, estando alojado en Instagram (https://www.instagram.com/pikolinos_shoes/) y será de ámbito internacional.

El período durante el cual estará abierta la participación en el Concurso será desde las 16:30 pm del 7 de febrero de 2022 hasta las 23:00 pm del día 13 de febrero de 2022 hora España peninsular. Este período podrá ser ampliado o reducido por Pikolinos si así lo estimase oportuno, comunicando tal decisión en la página y bases correspondientes. Las presentes Bases establecen los requisitos y la normativa de participación que deben ser aceptadas por todas aquellas personas que quieran participar en el Concurso (en adelante, los Participantes o, individualmente, El Participante). La participación efectiva de los Participantes en el Concurso por los medios que aquí se establecen, supondrá de forma inequívoca y sin excepción alguna que ha habido una aceptación de la totalidad de los requisitos y la normativa que aquí se estipulan.

2º.- PARTICIPANTES

Podrán participar gratuitamente en el concurso todas aquellas personas mayores de edad que cumplan todos los requisitos establecidos en las presentes bases.

No podrán resultar ganadores de esta promoción los trabajadores y colaboradores de la empresa convocante.

3º.-COMUNICACIÓN Y PUBLICACIÓN DE LA PROMOCIÓN

El presente concurso se comunicará a través de los siguientes medios:

4º.- MECÁNICA DEL CONCURSO Y DE LA PARTICIPACIÓN

– En relación con la Política de Protección de Datos, les rogamos consulten el Punto 10 de las presentes bases.

En el caso de que Pikolinos detecte un mal uso, actos fraudulentos o perjudiciales para los restantes participantes por parte de uno o varios participantes, podrá dar de baja la participación de dichas personas infractoras. En el caso de que Pikolinos, así como cualquier otra entidad ligada a ella, detecte cualquier anomalía o sospeche que un participante está impidiendo el normal desarrollo del Concurso alterando sus registros mediante cualquier procedimiento técnico o informático o llevando a cabo cualesquiera actos fraudulentos que contravengan la transparencia de la promoción se procederá a dar de baja a dicho participante, así como a emprender las acciones legales oportunas.

5º.- ELECCIÓN DEL GANADOR

Se designarán 2 ganadores entre todas las participaciones recibidas, completas, y correctas antes de la fecha de finalización a través de un sorteo aleatorio en la plataforma Sortea2.com. El ganador recibirá como premio un par de zapatos Pikolinos a su elección. 

6º.- MECÁNICA DEL CONCURSO Y NOTIFICACIÓN DEL PREMIO

Los nombres de los ganadores serán publicados en el post de instagram y stories.

Pikostore S.L.U. se reserva la capacidad para sustituir al ganador por otro concursante, en caso de sustitución, no aceptación o la imposibilidad de ponerse en contacto con el ganador. En ese caso, el agraciado/a perderá los derechos sobre el premio, siendo otorgado el premio al segundo ganador y si éste segundo ganador tampoco pudiera ser contactado en el plazo de treinta (30) días naturales desde la elección del ganador o se dieran las circunstancias anteriormente enumeradas, el premio será declarado desierto.

7º PREMIO

Los ganadores del concurso de “SAN VALENTIN” optarán al siguiente premio:

– El premio consiste en dos pares de zapatos Pikolinos a su elección.

Si por cualquier razón ajena a Pikolinos, no hubiera disponibilidad del premio previsto, ésta se reserva el derecho de sustituirlos por otros, de igual coste.

– Pikolinos se exime de toda responsabilidad con respecto a las incidencias que ajenas a su voluntad, pudieran ocasionarse en el transcurso del premio.

– El ganador del presente concurso no podrá canjear el premio ganado por otro distinto ni por la cantidad equivalente al mismo.

Pikolinos no será además responsable de los siguientes extremos:

– Por los servicios que terceras empresas deban prestar con motivo del premio de la presente promoción.

– Por daños y perjuicios de toda naturaleza que puedan deberse a la falta temporal de disponibilidad o de continuidad del funcionamiento de las redes de telecomunicaciones.

El premio no es canjeable por dinero ni por cualquier otro objeto en especie.

8º.- PUBLICIDAD DEL PREMIO

La aceptación expresa del premio por parte de cada ganador/a implica:

a) Que usted autoriza a Pikolinos (o cualquier tercero autorizado por ésta) a utilizar su nombre, la imagen y/o comentarios hechos por los Participantes, en el supuesto de ganar el premio, con fines de marketing, promoción y publicidad del Concurso en cualquier medio y en cualquier parte del mundo, sin ningún tipo de remuneración por ello.

b) Que su nombre aparezca publicado en los canales de comunicación oficiales de Pikolinos.

9º.- PROTECCIÓN DE DATOS

De acuerdo con la normativa vigente en materia de protección de datos la Finalidad del tratamiento es:

a) La participación en los concursos, promociones y sorteos organizados por PIKOLINOS. La base legal para el tratamiento de sus datos es el consentimiento del interesado y/o su representante legal y los datos serán guardados hasta la finalización del sorteo, así como durante el tiempo necesario para cumplir con las obligaciones legales que puedan ser de aplicación.

Destinatarios de datos: No se realizarán cesiones de datos salvo, en el caso de que nos haya dado su autorización para la cesión de la imagen, a redes sociales, medios de comunicación y al público en general y solamente con la finalidad de promocionar y dar a conocer el sorteo realizado por PIKOLINOS.

Transferencias Internacionales de datos: No se realizarán transferencias internacionales de datos.

Derechos del interesado:

– Acceso: derecho a obtener confirmación sobre si estamos tratando datos personales suyos o no, a saber, cuáles son, para que se usan, cuánto tiempo se van a guardar, el origen de los mismos y si se han comunicado o se van a comunicar a un tercero.

– Rectificación: derecho a solicitar la rectificación de los datos inexactos y a que se completen los datos personales incompletos.

En ambos casos, deberá acompañar la documentación pertinente.

10º.- EXCLUSIONES

No podrá resultar ganadora ninguna persona que no cumpla total y adecuadamente los requisitos de participación descritos en las presentes Bases.

Quedan excluidos del premio los trabajadores y colaboradores del Grupo Pikolinos.

11º.- ACEPTACIÓN DE LAS PRESENTES BASES

La participación en este concurso implica, por sí misma, la aceptación de las presentes bases, así como las decisiones interpretativas que la sociedad haga de las mismas.

12º LEY APLICABLE Y JURISDICCIÓN

Las presentes bases legales se interpretarán y regirán de conformidad con la legislación española.

Para cualquier cuestión litigiosa derivada de la existencia, acceso, utilización o contenido de las Bases Legales, tanto el cliente como Pikolinos, se someterán:

· A los juzgados y tribunales de la ciudad de Elche, o de no existir juzgados de lo mercantil tal ciudad, serán competentes los de Alicante cuando el usuario sea empresario.

· A los juzgados y tribunales de la ciudad del domicilio del usuario, cuando se trate de un consumidor de acuerdo a la legislación vigente.

LEGAL BASES “SAN VALENTÍN” DRAW

Pikolinos, whose corporate name is Pikostore S.L with NIF B53906590 and with registered office at Galileo Galilei, 2, 03203-Elche (Spain). Telephone 965681234, email: info@pikolinos.com, carries out a commercial promotion called “SAN VALENTÍN” (hereinafter, the draw) to promote the activities of the company and that will be developed under the following conditions.

Pikostore S.L.U. reserves the right to postpone, cancel, modify the rules, repeat or terminate the contest at any time if exceptional circumstances concur, communicating those circumstances to avoid any harm to the participants in the draw.

1º- SCOPE AND DURATION

The draw will take place through the social networks of PIKOLINOS, being hosted on Instagram (https://www.instagram.com/pikolinos_shoes/) and will be national (Spain).

The period during which the participation in the draw will be open from 4:30 pm on 7th February 2022 until 11:00 pm on 13th February 2022, peninsular Spain time. This period may be extended or reduced by Pikolinos if it deems appropriate, communicating such decision on the corresponding page and bases.

The present Bases establish the requirements and the rules of participation that must be accepted by all those people who want to participate in the draw (hereinafter, the Participants or, individually, The Participant). The effective participation of the Participants in the draw by the means set forth herein, will unequivocally and without exception imply that there has been an acceptance of all the requirements and regulations stipulated herein.

2º- PARTICIPANTS

All persons of legal age who meet all the requirements established in these rules can participate for free in the contest.

The workers and collaborators of the convening company cannot be winners of this promotion.

3º- COMMUNICATION AND PUBLICATION OF THE PROMOTION

This draw will be communicated through the following means:

4º- MECHANICS OF THE DRAW AND PARTICIPATION

In the even that Pikolinos detects misuse, fraudulent or harmful acts for the remaining participants by one or more participants, you can cancel the participation of such infringing persons. In the event that Pikolinos, as well as any other entity linked to it, detects any anomaly or suspects that a participant is preventing the normal development of the draw by altering their records through any technical or computer procedure or carrying out any fraudulent acts that contravene the Transparency of the promotion will proceed to cancel said participant as well as take appropriate legal action.

5º.- WINNER’S CHOICE

Two winners will be designated among all entries received, complete, and correct before the end in a random drawing on the platform Sortea2.com.

6º.- MECHANICS OF THE DRAW AND NOTIFICATION OF THE PRIZE

The names of the winners will be published on the instagram’s post and stories.

Pikostore S.L.U. reserves the capacity to replace the winner with another contestant, in case of substitution, non-acceptance or the inability to contact the winner. In that case, the grantee will lose the rights to the prize, the prize being awarded to the second winner and if this second winner could not be contacted within thirty (30) calendar days from the election of the winner or the circumstances listed above occur, the prize will be declared void.

7º- PRIZE

The winners of the “SAN VALENTIN” draw, will opt for the following prize:

– The award consists of a two pairs of Pikolinos shoes of the winner’s choice.

If, for any reason outside Pikolinos, there is no availability of the planned prize, Pikolinos reserves the right to substitute them for others, of equal cost.

– Pikolinos shall not be held liable about incidents beyond its control, which may occur during the award.

– The winner of this contest may not exchange the prize won for a different one or for the amount equivalent to it.

Pikolinos will not be responsible for the following extremes:

– For the services that third companies must provide for the award of this promotion.

– In case of failure or any other incident in telecommunications systems, which prevent access to the promotion website with normality.

– For damages of any nature that may be due to the temporary lack of availability or continuity of the operation of telecommunications networks.

The prize is not exchangeable for money or any other object in kind.

8.- PRIZE PUBLICATION

The express acceptance of the prize by the winner implies:

a) That you authorize Pikolinos (or any third party authorized by it) to use his name, the image and / or comments made by the Participants, in the event of winning the prize, for marketing, promotion and advertising purposes of the draw in any means and anywhere in the world, without any remuneration for it.

b) That your name is published in the official communication channels of Pikolinos.

b) Sending commercial communications through the Newsletter. The legal basis for the treatment of your data for this purpose is the consent of the interested party and/or his legal representative and the data will be kept until its deletion is requested by the interested party and/or his legal representative.

11º.- ACCEPTANCE OF THE PRESENT BASES

Participation in this contest implies, by itself, the acceptance of these rules, as well as the interpretative decisions that society makes of them.

12º.- APPLICABLE LAW AND JURISDICTION

These legal bases will be interpreted and governed in accordance with Spanish legislation.

For any litigious issue arising from the existence, access, use or content of the Legal Bases, both the client and Pikolinos, will submit:

– To the courts and tribunals of the city of Elche, or if there are no commercial courts of that city, those of Alicante will be competent when the user is an entrepreneur.

– To the courts and tribunals of the city of the user’s domicile, in the case of a consumer in accordance with current legislation.
